Terms of Use - ClearAir App

1. Acceptance of Terms

By downloading, installing, or using the ClearAir mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

ClearAir is a mobile application designed to help users reduce or quit vaping through logging and goals, progress and analytics, educational and structured programs, reminders and notifications, optional read-only connections to Apple Health on iOS and Health Connect on Android where available and when you choose to connect, and tools that may use artificial intelligence ("AI"). Some experiences are available without registration; others require an account. The App offers both free features and Premium subscription or lifetime purchase features, as labeled in the App.

3. Subscription Terms

Subscriptions and purchases

• Premium Monthly Subscription: auto-renewable every 30 days, pricing shown in the App at purchase.
• Premium Annual Subscription: auto-renewable every 12 months, pricing shown in the App at purchase.
• ClearAir Lifetime: one-time purchase for ongoing Premium access, pricing shown in the App at purchase.
• Payment: charged to your Apple ID or Google Play account, or as otherwise shown at checkout.
• Auto-renewal: paid subscriptions renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation: you can cancel paid subscriptions through your device's subscription settings.
• Refunds: subject to Apple and Google policies. We do not guarantee refunds for unused portions of subscription periods.

Premium features may vary by platform, region, or App version

Premium is a bundle of benefits that may include, when available in your build of the App:

• AI coach chat tied to your cessation context, not a human therapist or clinician.
• Predictive craving notifications informed by your usage patterns, subject to device permissions and fair-use limits.
• Weekly insight summaries generated with AI assistance.
• Structured multi-week programs with enrollment and progress tracking.
• Crisis or SOS support tools intended as adjunct support, not a substitute for emergency services.
• Voice journaling with AI reflection.
• Relapse recovery guidance and AI-assisted reflections.
• Advanced analytics and personalization, premium activities, and priority support as described in the App.

We may add, change, limit capacity for, or discontinue individual Premium benefits over time. If we materially reduce Premium value for paying subscribers, we will take reasonable steps to notify you as described in these Terms or in the App.

4. User Accounts and Data

• You may register or sign in using email and password, Sign in with Apple, or Sign in with Google where available. If you use Apple or Google sign-in, your use of those services is also subject to their applicable terms and privacy policies.
• You are responsible for maintaining the confidentiality of your account and for activity under your credentials.
• You agree to provide accurate and complete information.
• We collect and process data as described in our Privacy Policy.

5. Acceptable Use

You agree not to use the App for unlawful purposes, interfere with functionality or security, harass others or misuse support or interactive features, misrepresent your identity or misuse Premium access, or reverse engineer the App except where permitted by law.

6. Intellectual Property

The App and its content are protected by copyright, trademark, and other intellectual property laws. All rights are reserved by ClearAir.

7. Third-Party Services and AI-Generated Content

Parts of the App rely on third-party infrastructure. Outputs from AI features are generated automatically and may be inaccurate, incomplete, or inappropriate for your situation. You should not rely on AI responses as medical, legal, or professional advice. ClearAir does not guarantee availability or accuracy of any third-party service.

8. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. ClearAir does not warrant that the App will be error-free or uninterrupted.

9. Limitation of Liability

To the fullest extent permitted by law, ClearAir shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted.

10. Health and Crisis Disclaimer

ClearAir is not a medical device, medical service, or substitute for care from a licensed professional. Nothing in the App is a diagnosis or treatment. The SOS and related tools are not a replacement for emergency services. If you are in immediate danger or experiencing a medical or mental health emergency, contact local emergency services or a crisis hotline in your area.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective when posted in the App and, where required, when we provide additional notice. Continued use after changes constitutes acceptance unless applicable law requires otherwise.

12. Termination

We may suspend or terminate your access to the App for violation of these Terms or for operational or legal reasons, subject to applicable law.

13. Governing Law

These Terms are governed by the laws of the United States and the State of California, excluding conflict-of-law rules.
